No, this is legit. He’s got the memories, so he counts as if he had the years. Just like plastic!Rory counted as Rory even though origional!Rory was dead. He had the memories, so he counted as a person. It follows the Doctor’s rules about what makes a person, anyway. So I’d figure his memories count, too. After all, memories are a big deal in a time travel-rich universe. Lots of stuff the Doctor remembers ‘never happened’. Doesn’t make it not count.
